Minor (Child) Travel Consent Form – EXPLAINED

A Minor Travel Consent Form is a without a parent or guardian.

This legal document is needed when a child travels for a school trip or with a group. Itâs also needed when a minor travels with an adult that isnât their parent or guardian.

The document is also vital if a minor istraveling alone.

There are 2 types of travel that a Travel Consent Form for Minors should be used:

What Documentation Do I Need From My Co

Once you’ve determined whether any documentation is needed for your trip, you’ll need to create that documentation with all relevant information should you run into the need to use it.

While there are no strict guidelines as to what must be included in a child travel consent letter, a general rule of thumb is to include who, what, where, when, and how to get in contact.

  • Who will be traveling with the children?
  • Who are the legal guardians of your children? List the full legal names of everyone whose permission is required.
  • How can you contact your co-parent or child’s other legal guardians? Provide a phone number and secondary form of contact for everyone listed on your consent to travel form.
  • For what are you asking permission? Make sure the consent letter clearly indicates whether the permission is to travel out-of-state or abroad.
  • Where will you be taking your children? Clearly outline your travel plans in the consent letter.
  • When will you be traveling? Provide clear itinerary dates for your trip.
  • Beyond including this information, it is highly recommended that parents sign their child’s travel consent letter in the presence of a notary public.

    I Am Travelling With My Minor Child Without My Spouse What Documents Must I Present

    You must present the following documents:

    • A copy of the childs birth certificate
    • A letter of authorization signed by the parent who is not travelling, containing their address and telephone number, in English or French if possible, and
    • A photocopy of the non-accompanying parents signed passport or national identity card

    If the parents are separated or divorced, and share custody of the child, the parent travelling with the child should carry copies of the legal custody documents.

    If the parents are separated or divorced and one of them has sole custody of the child, the letter of authorization may be signed by that parent only and they should bring a copy of the custody papers.

    If one of the childs parents is deceased, the travelling parent should bring a copy of the death certificate.

    How Old Does A Child Have To Be To Travel Alone

    A child must be at least five years old to travel without a parent or guardian. This must be for a direct flight, with no connections.

    Children eight years old and older may fly with connections and be escorted by airline personnel to their gate. Its recommended all minors under the age of eighteen years old carry a travel consent form.

    Child Travel Consent Forms Must Include Travel Date And Destination Information And Contact Information Of Everyone: Parents/guardians Child And Adult Travelers

    At a minimum, the form must include the childs full name and contact information, the parent and guardian contact information, details of the childs travel arrangement, including with whom the child is traveling, the childs destination, and the dates of travel for which the consent applies.

    In the case of multiple legal parents/guardians, each parent/guardian should be listed on the form and sign it. This is particularly important when parents are separated or divorced and have joint custody. If youre taking someone elses child with you on your family vacation, you dont want to be caught in the middle of a custody dispute. If you cant get written consent from each parent and guardian, dont take the child with you.

    Get Permission From Someone With Parental Responsibility

    A letter from the person with parental responsibility for the child is usually enough to show youve got permission to take them abroad.

    You might be asked for the letter at a UK or foreign border, or if theres a dispute about taking a child abroad. The letter should include the other persons contact details and details about the trip.

    It also helps if youve:

    • evidence of your relationship with the child, eg a birth or adoption certificate
    • a divorce or marriage certificate, if you are a single parent but your family name is different from the childs

    Travel Prepared To Avoid Confusion

    Thorough documentation is especially important in situations such as travelers or guardians with different last names than each other or the minor. FTF also recommends that birth parents who have different surnames than their child carry a photocopy of the childs birth certificate while traveling, providing legal evidence of guardianship in case of trouble.

    Same sex couples, and adoptive, divorced or widowed parents should carry certified custody or death certificates, adoption papers, or other proof of sole custody, as well as photo identification for themselves and the child.

    Although travel agents and, occasionally, the fine print on a brochure, are supposed to notify families that airlines, cruise lines and bus tours may require proper documentation or deny boarding the paperwork can, and often does, slip between the cracks.

    Information To Include In A Consent Letter

While it may be tempting to obtain a blanket consent letter that can be used for multiple trips, the lack of detail may pose a problem for authorities. In addition, a consent letter that is undated or signed too far in advance may not be considered acceptable.

    The contents of the letter will vary depending on the situation, but in general, it is recommended that the following information be included:

    • The full name and date of birth of the child and their passport details
    • The full name and date of birth of the travelling parent and their passport details
    • The dates of the trip, including any dates of travel between destinations throughout the trip
    • The travel destinations and the addresses where the child will be staying at each location
    • Contact information for the consenting parent

    It is recommended that the consenting parent sign the letter in the presence of a notary public to reduce the chances that the letters authenticity will be questioned by authorities. The travelling parent should carry the original, notarized letter with them rather than an electronic copy if possible. The Government of Canada provides a template for a travel consent letter for parents to use however, if the travel plans are extensive, it may be necessary to write a lengthier document.

    Some Terms In The Divorce Act Changed On March 1 2021

    Effective March 1, 2021, the federal Divorce Act uses terms similar to those in the BC Family Law Act.

    • The terms and parenting time replaced “custody.”
    • The terms contact and parenting time replaced “access.”

    If you’re travelling outside of Canada with your children, you’ll probably be asked to prove that you’re allowed to take your children out of the country if:

    • you’re travelling without the child’s other parent, or
    • you’re their only parent.

    You’ll need certain documents to do this:

    • If you share parenting of your children with someone else, bring a letter from that person that says they give you permission to take the children out of Canada. The Government of Canada website recommends you use their consent letter.
    • If you don’t share parenting of your children with anyone else, bring legal documents that prove you don’t need to ask anyone for permission to travel with them on your own. For example:
    • a death certificate ,
    • a court order that shows you can travel with your child without asking anyone first, or
    • an agreement that says you can travel with your child without asking anyone first.

    You’ll also need these documents:

    • when you apply for passports for your children, or
    • any time you need to show you’re the only guardian or person with a Divorce Act parenting order .

    Hi, Im Andrew Feldstein of Feldstein Family Law Group. Today I will be discussing a parents right to withhold consent for a childs travel to socially or politically unstable regions.

    As you may be aware, a parent wishing to travel outside of Canada with his or her child must first obtain consent to do so from the childs other parent, unless the other parent is also accompanying the child or there is a court order dispensing with consent of the other parent. This is true regardless of whether the parents are married, unmarried, separated, or divorced. Even those with sole custody must obtain consent from the childs other parent before the child may travel abroad. The necessary travel consent must be in writing and it is best to have the document notarized.

    Understandably, many parents are reluctant to provide consent for their children to travel to parts of the world experiencing political or social conflict. This raises the question of whether one parent can force the other parent to consent and when consent can be refused.

    The question of when withholding consent is reasonable vs unreasonable can be a complicated one. Although Canadian courts have recognized that there can be legitimate concern regarding a childs safety while visiting politically or socially unstable regions, there is no set list of destinations that are deemed too unsafe.

    A Child Traveling With One Parent

    If a child has two married parents and is traveling with only one parent, their travel consent form should be signed by the parent with whom they are not traveling. If the parents are separated or divorced and share custody, the form should be signed by the parent who is not traveling. If the parents are separated or divorced, only one parent has custody, and the child is traveling with the parent who does not have custody, the custodial parent should sign the form and the non-custodial parent should travel with both the form and a copy of the custody order. If the parents are separated or divorced, only one parent has custody, and the child is traveling with the parent who does have custody, there is no need for a child travel consent form, but it is advisable that the parent travels with a copy of the custody order just to be safe.

    In an era of heightened global security, many foreign countries are revising their visa and documentation procedures as well. Laura Tischler, a spokesman for the Bureau of Consular Affairs at the U.S. Department of State advises families: Contact the embassy of your destination country or study the Consular Information Sheets provided at travel.state.gov to find out what that countrys requirements will be in terms of documentation, in order to bring a child into the country.

    A March 2019 report by Scott McCartney in the Wall St. Journal noted some other documents which might prove essential, depending on the destination. These include an original, raised stamp birth certificate for each minor in your party, extra passport photos on white backgrounds, plus about US$50 in small bills so that you can purchase entry visas on the spot. Be sure to assign a neighbor or relative back home the responsibility of retrieving some of these documents and sending them, if you need them after departure.

    As one of our editors and her son discovered while checking in for an American Airlines flight to Cancun, Mexican law requires that if only one parent or non-custodial adult is accompanying a minor under 18 from Mexico, he/she must carry a notarized Permission to Travel Letter from the childs other parent or guardian granting permission to leave Mexico with the child, including the dates of travel, the accompanying adults name, contact information, and a notarized signature.
