Preparing For The Future With Family Care Plans

Stacy E. Goodbread | New Braunfels, TX | Divorce Attorney

If you are going to be deployed overseas, you can take steps to prepare for the future by creating a family care plan. The Department of Defense recently required service members with joint or legal custody of a minor child to develop a family care plan. These plans are very helpful for single parents and families with two military parents.

Our firm can help you consider the important elements to include in a family care plan, like housing, transportation, food, medical care and other important matters that involve the health and well-being of your child.

There are limits to what can be withheld from ex-military personnel. Usually 50% of the members retirement pay not related to disability is subject to garnishment and withholding. Why You Need An Experienced San Antonio Military Divorce Attorney

The issues of custody, property division and support payments are even more complex issues in military divorces. There are two particular laws that apply to military divorces to help ease the stress of this process for military families:

  • The Servicemembers Civil Relief Act protects members who are in active duty and stationed out of the country. This act allows them to postpone divorce proceedings until they can attend.
  • The Uniformed Services Former Spouses Act protects the rights of military spouses. It imposes the spouses state laws on the divorce proceedings. It also classifies military retirement pay as property instead of income, so military spouses can recover financial assets in property division.

Navigating a military divorce with these laws can be difficult. Service members who are on active duty will need legal counsel to advocate for child custody and their parental visitation rights, since frequent deployments can seriously impact your military family custody arrangement.

Under the USFSPA, not paying support payments is grounds for a charge of misconduct. So, it is essential to retain an attorney who can protect both your rights as a parent as well as a service member.

As a former JAG lawyer, family law attorney Disrud understands the issues affecting military service members and will draft your decree correctly the first time. In addition, we can help correct existing decrees.

How Do I Serve Divorce Papers On My Deployed Spouse

Getting a divorce while your spouse is overseas or deployed can be difficult, but not impossible. Starting the process now can help ensure a more timely divorce, although a variety of factors can affect the timeline. In both civilian and military divorces, one spouse files a petition for divorce and another party serves the other spouse with legal documents.

However, with an active-duty servicemember, legal documents must be served in person no matter where they are and your spouse must acknowledge receipt of these documents. In some cases, this may be impossible due to the nature of military work. Upon return from deployment, servicemembers are allowed a stay of up to 90 days under the SCRA before resuming their case, as long as they notify the court.

Servicemembers may also waive these protections and requirements if the divorce is uncontested and the spouses agree on all terms of the divorce. The San Antonio attorneys at Grable Grimshaw advise speaking to a member of our team for guidance.

Legal Protection For Civilian And Military Spouses

Both spouses in a military marriage typically have the same primary concerns: They want to be protected financially, and they want to protect their relationship with their children. I educate individuals about the factors that are considered when military benefits are divided.

I also help parents protect their rights when parenting plans are being created. Although a traditional 50-50 custody and visitation schedule may not work, I can work with you to create a plan that is tailored to the unique needs of your family.

Phase One Divorce Petition

The petition for divorcewhich is the official term for the legal paperworkis prepared and filed with the court. The party filing the petition is called, rightfully, the Petitioner. The other party is called the Respondent. In straightforward terms, the Petitioner sues the Respondent for divorce.

Filing officially starts the lawsuit and the clock on the 60 day cooling off period. Upon filing, the clerk of the court prepares a notice to the Respondent. The notice is called the citation and it is accompanied by a copy of the petition. The citation informs the Respondent that he or she is being sued and states the deadline for filing an optional response with the court. It usually takes the clerk a day or two to prepare the citation.

How Do You Find A Good Texas Lawyer

  • To find the right Texas lawyer, you need to ask questions pertinent to your legal case. You should find an attorney to meet your specific needs. Questions to ask before hiring a lawyer may include:

  • How much experience do you have with cases like mine?
  • Do you know the judge or prosecutor in this case?
  • Should I take this case to mediation?
  • What are your legal fees and expenses?
  • Are you available after hours for questions?
  • Which lawyers or associates will I be dealing with?
  • Do I have to appear in person for my case?
  • Where is your Texas law office located?

Some people find a lawyer based on a recommendation from a friend or family member but you should do your own evaluation. A friend who suggested a divorce attorney may not be in the best position to recommend a criminal defense law attorney or tax lawyer. Dealing with legal issues can be complicated and frustrating. You should find the right lawyer that you can connect with to provide you with information, advice, and the legal aid you need.
