Are Divorce Records Public

In the state of Florida, divorce is considered a family court matter, which in and of itself is a civil court matter. Family court records are available to the public unless they have been expunged or sealed by order of the court. All people of the public may access divorce records in-person at the county clerkâs office or online, although it is possible to find more complete records online. To access these records online, the requesting party needs to submit fully completed application forms to the county clerkâs office. The information that is required in these request forms include the user’s name, address, email address, and phone number. Requesting parties must also provide a reason for using the courtsâ online record systems. Additionally, online access requires paying for a subscription.

Divorced parties may apply to the court to have some or all of their divorce records sealed. Florida Family Courts rarely grant requests to seal all divorce records. However, they may restrict access to court documents containing sensitive information such as financial information.

How Do I Get Divorce Records In Florida

Divorce records are available to the public and may be accessed by authorized persons. Authorized persons include the actual parties involved and the legal practitioners that were a part of the divorce proceedings. In Florida, divorce records may be obtained through any of these means

  • Walk-in request to the office of the Clerk of the Circuit Court
  • Online via the website of the Clerk of the Circuit Court

A nominal fee may apply during the process of each request. This processing fee varies from county to county and the channel through which the request is made. Address and contact information of all Circuit Courts in Florida is available online on the Florida Circuit Court website.

The Florida Bureau of Vital Statistics also provides copies of Florida divorce certificates. It has records dated as far back as June 6, 1927. The process of request involves the payment of a $5 fee or $10 to expedite the request. An extra $4 may be paid for additional certified copies in the same order. Where the exact year is unknown, a search fee of $2 per calendar year may apply.

Requests for Florida birth records or birth certificates are processed by Local County Health Departments and the Florida Bureau of Vital Statistics. The requirements for accessing birth certificates through county health departments generally varies depending on the judicial district. As such, requestors are required to contact the departments for information regarding their respective requirements.

To order birth certificate copies from the state Bureau, interested and eligible persons are required to download and complete the state’s birth record application.

Where the requestor is the registrant, an immediate family member or legal representative, the completed application must be accompanied by a copy of a government-issued photo ID. An applicant can also request for a birth certificate replacement if the need arises. However, if the applicant is neither of the aforementioned persons, the application must be accompanied by an affidavit to release a birth certificate which must be signed by one of the eligible persons and notarized. What Information Do I Need To Search For Florida Vital Records Online

To search for vital records online, requesters are generally required to provide record-related information to facilitate the search. This information includes:

  • The place and approximate date of the vital event
  • The full name of the person named on the record
  • Former or maiden names
  • The case file number of the record The license-number and issuing date of the record

Under Florida law, on or after October 1, 2002, any person preparing or filing a document for recording in the Official Record may not include a Social Security number or complete bank account, debit, charge, or credit card number in such a document unless required by law.

Any person has the right to request the Clerk to redact/remove his or her Social Security number, bank account number, credit, debit or charge card number from an image or copy of an Official Record that has been placed on the Clerks publicly available Internet website, or in a court file.

How To Order A Florida Dissolution Of Marriage Certificate

Florida dissolution of marriage certificates from June 6, 1927 to present that have been recorded by the Clerk of Circuit Court are available through the Bureau of Vital Statistics. The certificate is issued as an abstract of the information taken from the judgment and is acceptable as evidence that a dissolution was finalized and granted. The actual judgement may be obtained from the Clerk of Circuit Court in the county where the dissolution was granted.

After a dissolution of marriage has been recorded with the Clerk of Circuit Court, the Clerk forwards a report to the Bureau of Vital Statistics for permanent filing. This process takes approximately 60 days. If the current dissolution of marriage is less than 60 days from the date of application and immediate evidence is required, you may contact the county Clerk of Circuit Court where the dissolution was granted.
