San Antonio Contested Divorce Lawyer Serving Bexar County
It is reasonable to assume that you are not getting along with your spouse if you have made the decision to end your marriage. When you and your spouse cannot agree on major aspects of your divorce, you will have to pursue a contested divorce. The contested divorce process is typically more expensive and time-consuming compared to situations in which you are able to cooperate with the other party out of court.
At Brandon Wong & Associates, we can advise you on the best ways to protect yourself during the divorce process. While we believe in helping you pursue an uncontested divorce and resolving matters outside of the courtroom when possible, we know that some disputes may need to be addressed through litigation in court. We are prepared to advocate on your behalf during your case, and we will work to resolve disputes as efficiently as possible while doing everything possible to help you achieve your goals.
How Long Does It Take To Finalize A Divorce In Texas
In our state, a divorce cannot be finalized for at least 60 days after the petition is filed, and it typically takes six months to over a year. The divorce is not final until a judge pronounces it so in open court and signs the decree of divorce.
Our divorce attorneys are available to answer any additional questions you may have. We appreciate that each marriage and divorce is unique. We take the time to understand your specific situation to give you the best possible advice.
Avoid Traditional San Antonio Family Law Attorneys If Your Case Is Likely To Be Uncontested:
An uncontested divorce is simply one in which the parties will not be disputing any issues, including the divorce itself. The parties dont have to be happy and they dont have to like each other. They are either completely or mostly in agreement on all issues and are wise enough to recognize that traditional full-representation divorce lawyers would be the only winners if they contested relatively unimportant issues in their divorce.
Traditional full representation by a local San Antonio divorce lawyer is when that lawyer will represent you in all aspects of your divorce case. It is highly likely to be a good service, but it is expensive.
If you have a contested case, a complex case, a high-value case or a case that involves domestic violence or the threat of domestic violence, full representation by a San Antonio divorce lawyer is NOT to be avoided. It is a necessity.
A contested case means that you and your spouse/partner are disputing ANY issue in the case. A complex case contains legal complexities such as tax issues, active business issues, a special needs child of the marriage or any one of many other complex legal situations. A high-value case means that your marital estate is very large. There is no specific dollar limit. Certainly, if you have a high 7-figure net marital estate or higher, that is a high-value case.

Child Custody And Support
Whether they are part of a divorce case or not, child-related matters in court can be stressful. There are strict standards required by law that courts use to determine custody arrangements and child support orders, and the final outcome of your case can impact your finances and your relationship with your children into the future. We strive to help clients reach custody and support agreements that work for everyone involved and, if this is not possible, we know how to fight for your parental right in front of the judge.

Our Story
Premarital And Postmarital Agreements
Some engaged couples have good reason to draft and sign a premarital agreement. This agreement sets out terms in the event the marriage should end in divorce. While many people consider these agreements to be unromantic, they can be highly practical. The right agreement can protect your interests and property, while potentially saving you time, money, and adversity in the divorce process. Even if you did not sign a premarital agreement before marriage, it is possible to sign a postmarital agreement as a married couple should you decide it is right for you. Our San Antonio divorce attorneys can advise you whether an agreement is wise in your situation, and we can draft an enforceable agreement that protects your rights.

How Are Marital Assets Divided
-
The division of marital property after a divorce will generally depend on whether or not you live in a community property state. The best way to determine whether your state is a community property state is to talk to a local attorney who can tell you what the law is and who can help you understand how that affects your situation.
Community property states consider nearly all property obtained after the marriage as equally owned by both spouses. As a result, the property will generally be equally split after the divorce. Absent community property statutes, it’s typically up to the court to divide marital property between both parties. In either case, courts will normally accept a property division agreement if the spouses can create their own.

How A Conservatorship Works

Determining conservatorship is one of the primary responsibilities of the courts. A conservator can have the right to inquire, participate in, and make decisions regarding the childs education, health, after-school activities, what religion the child practices, and legal needs.
Because of the importance of these decisions, the courts always consider the best interests of the child when making their decisions. Factors that will be considered include:
- The ability to provide overall care and a stable environment for the child
- The childs emotional and physical needs
- The childs age and preferences
- The health of the parents
- Any history of abuse or neglect.
There are a few options regarding conservatorship. Sometimes, the courts determine that the parents should have joint managing conservatorship and share rights and responsibilities. On the other hand, sometimes they rule that one parent should have sole managing conservatorship . An SMC may also allow one parent to receive child support, usually paid by the non-custodial parent, until the child reaches 18 years of age and graduates from high school. If the child is disabled, in both JMCs and SMCs payments may continue after age 18. Texas courts will consider many factors in deciding which of several options for conservatorship to use.

Our Divorce Lawyer Can Help With A Spousal Maintenance Agreement
In a marriage, one person may earn significantly more money than the other. The reasons for this are numerous. Sometimes the difference can be explained based on the careers of both parties. For example, if one person is a social worker and the other a surgeon, income levels will be vastly different. In other situations, one party may have cut their career path short to support their spouse. Or perhaps one person stopped working to care for the children and the home while the other pursued their profession. In all three, an imbalance of earnings exists. Upon divorce, one person may face financial hardship. The court will take this into consideration, and one spouse may be awarded support to be paid by the other.

How Do Lawyers Get Paid If They Lose A Case

Lawyers typically charge for their time regardless of whether they win a case. Sometimes, the losing party is ordered to pay the other partys lawyer fees on top of their own. Some lawyers also work on contingency, meaning they will take a percentage of the awarded amount only if they successfully win the case.
Before hiring a lawyer, make sure you understand their fee structure.
